Terms & Conditions

The terms and conditions outlined below govern the relationship between 24x7 Bike4U - Bike Rentals (hereinafter referred to as "Company") and its Users. By accessing or using the Company's services through its website or mobile application (hereinafter referred to as "App"), Users agree to abide by these terms and conditions.

The Company reserves the right to modify these terms and conditions at its sole discretion, with or without prior notice. Users will be notified of any changes through means deemed appropriate by the Company.

1. Registration Process

  • Mandatory Registration: Users must complete the registration process through the website or App.
  • Documentation: Users must provide neccessary documents as outlined in Annexure B to meet the eligibility criteria.
  • Approval: Registration is subject to the Company's approval.
  • Mobile Number Usage: The registered mobile number will be used for all service requests and communications.
  • User Responsibility: Actions taken via the registered mobile number are considered authorized by the User.

2. Payment Process

  • Booking Amount: Payment must be made online during booking.
  • Extension Payments: Additional payments are required for booking extensions, subject to availability.
  • Accepted Payment Methods:
    • Net Banking
    • UPI
    • Paytm
    • Debit Card
    • Credit Card
  • Payment Gateway Charges: Governed by applicable laws and rules.
  • Vouchers: Taxes are exclusive and adjusted in subsequent bookings.

3. Delay Policy

  • A grace period of 30 minutes is allowed for vehicle returns.
  • Beyond this, a penalty of Rs. 1000 plus 3x the rental charges per hour will apply.

4. Required Documents

For Domestic Users:

  1. Driving License: Original Indian driving license (no learner licenses).
  2. Aadhar Card: Original Aadhar card. If the registered mobile number differs from the Aadhar number, an additional document (PAN/Passport) is required.

For International Users:

  1. Driving License: Valid home country license and international driving permit.
  2. Visa and Passport: Originals required.

Important:

  • Original documents must be presented at pickup for verification.
  • Failure to verify identity will result in booking cancellation with a 37.5% cancellation charge.

5. Use of Vehicle

  • Personal Use Only: Bookings must be made for the User's own use.
  • User Responsibility: The User is fully responsible for the vehicle during the rental period.
  • Vehicle Handling:
    • Be cautious, especially if inexperienced.
    • Age Restrictions:
      • 18-20 years: Can ride vehicles below 200cc (except Yamaha R15).
      • 21 years and above: Eligible for all vehicles, including superbikes.
  • Safety Gear:
    • Mandatory helmet use.
    • Appropriate riding gear (e.g., boots, pants, eyewear). Flip-flops, sandals, and shorts are not allowed.
  • Pickup and Return:
    • Vehicles must be picked up and returned to designated parking locations.
    • Home delivery requests are subject to availability and additional charges.
  • Inspection: Users must inspect the vehicle for damages or malfunctions at the pickup location and report any issues immediately.
  • Insurance:
    • Vehicles are insured.
    • Users can opt for additional personal insurance.
  • Responsibility Clause:
    • Users assume full responsibility for the vehicle during the rental period.
    • The Company is not liable for injuries, accidents, or damages caused during usage.
  • Vehicle Return Condition:
    • Vehicles must be returned in the same condition as received.
    • Excessively dirty vehicles will incur a cleaning fee (up to Rs. 200).

6. Additional Terms

  • Exclusions: Fuel, toll charges, roadside assistance, and taxes are not included in the rental package.
  • Traffic Violations: Users are responsible for any traffic violations incurred during the rental period. Violations must be reported to the Company promptly.

Towing Service

  • User Responsibility: Towing costs will be borne by the customer in cases of tire puncture, collisions, or breakdowns due to improper usage.
  • Company Responsibility: Towing costs are covered by the company in the event of mechanical or technical failure.

Usage Guidelines

  • GPS Tracking: Bikes are equipped with GPS; exceeding speed limits can result in a penalty of Rs.500 per instance.
  • Personal Belongings: While efforts will be made to return lost items, the company is not responsible for any loss.
  • EV Vehicles: A charger will be provided, and users must charge as per guidelines.

Prohibited Uses

  • Personal use only; no overloading passengers or goods beyond legal limits.
  • Prohibited activities: rallies, stunts, intoxicated driving, crimes, and illegal activities.
  • No modifications to the vehicle.
  • Minors are strictly prohibited from operating the vehicles.

Delivery Process

  • Vehicles will be delivered as per scheduled dates/times.
  • Users are expected to inspect the vehicle and report damages during delivery.
  • Exchanges are possible before handover if users are dissatisfied.

Right to Refuse Service

The company reserves the right to refuse service or terminate it for non-compliance with terms.

Handover Process

  • Users must notify the company two hours before the contract period ends.
  • The drop-off location must be the same as the pickup location.
  • Damage assessments will be conducted upon return.

Damage Policy

  • User Liability: Users are responsible for all damages, loss, or theft of vehicle parts.
  • Repair Costs: Maximum payable for collision-related damages is Rs.20,000 for bikes up to 150cc; above this, the user covers actual repair costs.
  • Inactive Charges: Repairs resulting in vehicle downtime incur charges at 50% of the daily rental rate.

Fuel Policy

  • Exclusions: Fuel is not included in the rental cost. Users will not receive refunds for unused fuel.

Communication

  • Users consent to receive SMS, calls, or emails regarding booking updates.
  • The company is not liable for communication errors arising from incorrect user information.

Maintenance

  • Users must check engine oil and report any mechanical failures during the trip.
  • Negligence in maintenance may result in user liability.

Cancellation Policy

  • No-show: Full rental charge withheld; only the security deposit is refunded.
  • Cancellations:
    • 0-6 hours before pickup: 75% rental withheld.
    • 6-24 hours before pickup: 50% rental withheld.
    • 24-72 hours before pickup: 25% rental withheld.
    • 72+ hours before pickup: 10% rental withheld.

1. Long-Term Booking Cancellation Policy:

  • Before Rental Period: 10% of the first month’s rent deducted.
  • During Rental Period: Half a month’s rent deducted.
  • Document Issues: 37.5% of the rental amount deducted if:
    • Documents aren't submitted or verified.
    • Invalid documents are provided.

2. Extra Charges:

  • Helmet: Additional charges for extra helmets on the spot.
  • Excess KM: Charged at drop-off, per vehicle’s rate.
  • Damages: Inspected at drop-off, charged as per terms.

3. Security Deposit:

  • Refundable: Instantly refunded post-trip in most cases.
  • Processing Refunds: Other refunds may take 7–12 working days.

4. Over-Speeding:

  • Speed limits differ by vehicle; communicated post-booking.
  • After 3 violations, subsequent breaches incur Rs.200 per instance.

5. Exceeding KM Limit:

  • Extra charges apply for exceeding km limits, as displayed during booking and finalized at drop-off.

6. Renting Helmets:

  • 1 Helmet Free: Additional helmets can be rented (maximum of 2 per booking).
  • Damage/Loss: Charged Rs.900 per helmet.

7. Information Usage:

  • Booking details may appear in popups. Personal information usage adheres to the Privacy Policy.

8. Assumption of Risk:

  • Acknowledges inherent risks in operating motorcycles (C.O.C.V.).
  • Riders agree to assume all risks, including accidents, damages, and mechanical issues.
  • Prototype models may involve additional risks.

9. Waiver and Release of Liability:

  • Riders waive all claims against the company and affiliated entities.
  • The waiver includes negligence, product liability, and warranty breaches.
  • The release is intended to be as broad and inclusive as legally permissible.

Important Clauses for Riders:

  • Pre-Ride Inspection: Riders are responsible for ensuring the vehicle is in good operating condition before use.
  • Alcohol/Drug Use Prohibition: Operating under the influence is strictly prohibited.
  • Compliance: Riders must adhere to eligibility rules and program conditions.

Legal Notice:

By accepting these terms, riders agree to:

  • Operate vehicles safely and within legal limits.
  • Waive their rights to sue the company or affiliates for any damages, injuries, or losses arising from vehicle usage.
